Where are you!?

Why, here I am!

OK where have I been and where is my post with pics on my spinning lesson?

The pics are still in the camera alas awaiting me to write up my story of the day in Folkestone with the fabulous Sue & Bill Chitty.

This is a brief run down of where I've been / what has happened. My life feels incredibly Kafkaesque right now...

I go to spinning class - love it

I go to work on the Monday, book a tetanus jab for the Tuesday morning as advised by Sue.

I get the jab, it is a combined Tetanus, Diptheria and Polio jab - I assume this is all that is available these days, since the advent of the MMR - I assume triple jabs are the thing nowadays.

I get sick. I get VERY sick. I get so sick in fact that I am floored with a temperature of 102 (and that was taken when the temperature was at a low point) and a headache like nothing I have ever felt in my entire life. It felt like the entire staff of Conway Construction (who happen to be updating some roads in London at the moment) are inside my head tapdancing and juggling with pneumatic drills. My entire body is a weak mess, unable to stand my muscles will not hold me up, in fact my muscles are screaming with agony every time I roll over onto my side or move my legs. I am housebound.

Meanwhile, cue someone (a man) going into my bank and procuring information they had no right to procure from a member of staff. Serious error of judgement on her part - long story on this but I discovered this entirely by accident.

Involved in this is the fact I'm a Landlord, I own the freehold to my building. Guy upstairs is selling, I paid buildings insurance - he refuses to pay. It is now disputed. People buying upstairs want to make substancial changes to the property, they need my permission. I'm not sure I'm happy about the changes, the guy who currently lives there threatens to take me to court for obstructing his sale!

Cue him saying the building isn't insured, my insurer (also my bank) appear to have told him he isn't insured. Funny that, wonder how he got that information - Oh wait lets go back to someone (a man) going into my local branch of my bank and procuring information on an account he had no rights to. The account is in my name, I have a particularly girly name (not my nickname that everyone knows me as since I was at school but my proper given name). How many men do you know with a proper very girly name? Uhh huh - none.

I of course can not accuse him of this, since he has not admitted this is how he procured information about the insurance policy that he should not have. The only time I will be able to accuse him of this is when I see the CC TV footage from the bank. Understandably, they are kakking their pants because they have breached the data protection act and are unlikely to ever let me see the footage since it implicates a member of their staff of gross misconduct and breaking the law.

I spent an afternoon sitting in the local police station waiting to report this as a crime. It is ongoing.

Cue the insurance arm of the bank, finally dealing with the issue, and admitting full liability and telling me the entire building was insured from 1997. In 2002 when the guy upstairs moved in, I called and told them of the change of tenant and that I wanted to add his property to the insurance (I am not actually legally obliged to insure the entire building - long complicated lease but it states the tenant must insure and produce insurance documentation for me - I insured out of courtesy assuming that he would pay me half the premiums). The premiums jumped up to almost double. Funny that. If it was already insured from 1997 why did the premium leap in 2002? They have seriously cocked up. They have told me they will no longer insure the building when the policy runs out - hardly surprising since their underwriters will not underwrite the policy if anything happens they will have to cover the costs themselves.

So cue me heading home relieved that ONE of the legal nightmares ongoing is resolved. I find a letter on my doormat, its from someone I don't know. They are telling me the neighbour next door wants to put in a loft conversion and that they feel I should be informed because it will affect me. Damn straight it affects me - I own the building they want a loft conversion but the wall between their place and my building will require having beams attached to it. I've not even seen the planning consents for this. I have to stop them from doing this since theres a HUGE dispute currently as to whether I own the loft space or just the walls. If I own the loft space, I get to sell it to the buyer of the upstairs flat. If I don't own it then I have the right to a consideration fee since the new owner wants to put a loft conversion in too.

I hope some of this legal stuff is making sense - to me its a huge quagmire. I'm about to incurr legal costs and I need someone to stand up and pay those costs. My solicitor is saying she will do the work but is away till the beginning of September. She will ensure that someone else pays the bill - I spent an hour on the phone to her and My God, shes the absolute dogs hoo has - she came out with so much stuff and is all riled up ready to fight my corner. Brilliant just the sort of woman I want to represent me!

Anyway that is where I've been. That is where I'm going to be for a little while longer while I try to resolve this, get my work done at work and go back to see the doc - I've just not picked up properly after having that jab and being sick with that jab.

Ah well, life goes on!

This sounds an interesting dispute, re: loft conversion they may not need planning consent as it may fall under permitted development. You how ever can go to your solicitor and ask about party wall agreements. You need to do this before they start building the loft! The steel beams will rest on what may be your party wall but should not effect you or your property.

Shame you cannot buy the upstairs and rent it out...don't suppose you have a rich relative.... ;-)

Hi Alexis and thanks fo the comment! They do need planning consent it isn't falling under permitted development and the building is in a conservation area so there are strict rules about what can and can't be done.

The neighbours conversion needs a party wall agreement from me and they have applied for planning permission. It has been rejected due to insufficient paperwork and they are on round two.

As for the upstairs flat.. the tenant is currently in breach of the lease. As Landlord I am permitted to repossess (it will never come to that though - it never does, his lender will step in and pay the outstanding monies before it comes to repossession or they have a debt with someone who has no collateral to put against it).

Wish I did have a rich relative I would buy it and rent it out if I could!! Funnily enough, the purchasors solicitor is lovely - very nice chap indeed. He might not be so nice when they work out that I own the loft space and could in effect turn it into a studio apartment and sell it ;) Even if I don't own the space, they will have to pay a consideration fee for the use of the space and the ground rent will be allowed to be put up in line with the additional square footage of the property.

I'll try to post more later on the actual blog so this gets seen =D

Jabs jabs jabs. They really do have an enormous effect on our bodies. Glad you're feeling better although I'm sure your current hassle is taking away from this.

I had a terrible reaction to the Pneumonia jab a few years ago and was off work for 2 weeks.
